Contract of Services for Online Tutoring.
These terms and conditions form the basis on which we provide our service online in the form of personalised tutoring. Please read them carefully as they contain important information.
General Terms and Conditions
1. The contract between us
We must receive payment of the whole of the price for the services that you order before your order can be accepted. Payment of the price for the services represents an offer on your part to purchase the services, which will be accepted by us only when confirmation of acceptance is sent by us. Only at this point is a legally binding contract created between us.
2. Acknowledgement of your order
To enable us to process your order, you will need to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.
3. Ownership of rights
All rights, including copyright, of live online tutoring sessions and training materials are owned by or licensed to PTO [Private Tutoring Online]. Any use of live online tutoring or training materials and contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything from the live online tutoring sessions or training materials for any purpose.
4. Accuracy of content
We have taken care in the preparation of our content, in particular to ensure that training materials and prices quoted are correct at the time of publishing and that all services have been described accurately.
5. Availability
The services will be provided within an agreed timescale, and time is not of the essence of the contract.
6. Price
All prices are inclusive of VAT at the current rates and are correct at the time of entering information.
7. Payment Terms
Your first payment indicates that you agree to the terms and conditions set out in this service contract. We will take payment upon receipt of your order from your credit or debit card. We accept no liability if our services are delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the services from you, then we can refuse to process your order and/or suspend any further services. This does not affect any other rights we may have. The first payment is a scoping call online which is designed to determine the appropriate methodology based on your child’s learning style and current attainment levels.
The pre-meet session will be at 37.5% of the total cost of tutoring. E.g.£40 session fee = £15 for pre-meet.
7.1 Pay as You Go [PAYO]
New clients are offered a PAYO service for two calendar months. This allows flexibility to ensure that the leaning pathway is right for your child and meeting both our expectations and yours. When at least two months of tuition have elapsed, you’ll be invited to enter into a long-term learning pathway agreed by both parties based on the learning needs of the child and the expected outcomes. A pre-paid plan for a set duration will become applicable.
7.2 Retainer fees
Retainer fees will be charged at 25% of the tutor’s rate for school holiday periods and 50% for school term times whilst engaged in a pre-payment plan. Holiday times will be defined around the academic official holiday period.
7.3 Annual fee Increases
We reserve the right to review our fee annually at the start of academic year you will be informed of any increases in fees in advance. Services could potentially be suspended and/or cancelled if fees cannot be agreed prior to the start of academic year.
8. Cancellation Rights
During the PAYO period you have the right to cancel at any time. After the PAYO period and once the learning pathway is agreed you will enter a pre-paid plan notice to cancel a session will be need will be 24 hours. If there is less than 24 hours’ notice, we reserve the right to charge the full session fee.
9. Cancellation by us
We reserve the right cancel the session if:
• You are not in the same room as your child
• We have insufficient staff or resources to deliver the session
• If the child’s conduct/ Behaviour falls below the required standard to run the session.
10. Technical Issues
If there is a technical issue or drop in connectivity either by the tutor or client, we reserve the right to reschedule the session for another time if the session is deemed ‘incomplete’. An incomplete session is deemed at 60% of the session time or less. These parameters are defined as: <36 mins for a 60-minute session; <27 minutes for a 45-minute session; or <18 minutes for a 30-minute group session.
If the session can be recovered, we will endeavour to complete the session as initially agreed in full
11. Student Results
While we will endeavour to ensure that the student makes satisfactory progress, this cannot be guaranteed, and the Tutor cannot be held accountable for the academic success of the student.
12. Child Protection
In rare instances, there may be cause for concern regarding the welfare of a student. In such instances advice will be sought with the local authority child protection officer: Child Protection Officer for Schools / LADO on 01482 392139

14. Privacy
You acknowledge and agree to be bound by the terms of our privacy notice.
Learning Agreement
Our commitment to you
1. Feedback: At the end of each session, I'll have a quick chat with the parent to share how things went. This will be part of the 45 or 60-minute session.
2. Next Steps: I'll suggest some next steps for your child's learning based on the session. If the parent is around and wants to hear them, I'll share these too.
3. Tailored Learning: The learning process will be unique to your child's needs. It will be challenging but doable. I'll use National Curriculum descriptors where possible, even if they are from different year groups.
4. Group Sessions: In group sessions, I'll adjust my questions to suit the different abilities of the children. This is especially important for interactive group activities.
5. Positive Praise: I'll make sure to give positive praise for any milestones, big or small. We can use custom reward charts or parental reward schemes to celebrate these achievements. These can be sent to the parents or provided digitally.

3. Provide Positive Reinforcement: Celebrate your child's achievements, no matter how small. Positive praise and rewards can motivate them to keep learning and trying their best.
4. Stay in Touch with Tutors: Regular communication with your child's tutor can help you stay informed about their progress and any areas where they might need extra support. This can be done through quick chats at the end of each session.
5. Set a Routine: Establish a consistent routine for online learning. This helps your child know what to expect and can make the learning process smoother.
6. Use Available Resources: Make use of any additional resources provided by the tutor, such as tailored learning plans or reward charts. These can be sent to you or provided digitally.
